Senator Tarr, Representative Wong Back 'Three Strikes' Bill Targeting Pedophiles

Senate Minority Leader Bruce Tarr and State Representative Donald Wong were guests on WRKO's Michelle McPhee radio show yesterday, where they called for the passage of a "Three Strikes" law targetting sex offenders who prey on young children. The bill, which is up for a hearing before the Judiciary Committee tomorrow, would impose a life sentence without any possibility of parole for anyone convicted of three sex offenses against a minor.

Senator Tarr and Representative Wong also called in to RushRadio 1200's "Jeff Katz" show this morning to raise public awareness of the issue and the upcoming hearing. Be sure to check out the Michelle McPhee interview and the Jeff Katz podcast.

AROUND THE DIAL: Caucus Members on Local TV and Radio Tonight and Tuesday A.M.

Members of the Senate Republican Caucus can be seen and heard on multiple media outlets over the next 24 hours discussing their efforts to reform the state's parole system and sentencing laws, as well as legislation cracking down on unlicensed drivers.

Senate Minority Leader Bruce Tarr is scheduled to appear as a guest on New England Cable News' "Broadside" program tonight to discuss parole reforms, as well as efforts to pass Melissa's Law, which would prevent habitual offenders from qualifying for parole after conviction for a third felony offense. Also joining Senator Tarr in-studio will be Melissa's father, Les Gosule, who has been fighting to change the law since his daughter's tragic murder nearly 12 years ago. The show airs live at 6 p.m., and will be repeated at 8 p.m. and again at 3:30 a.m.

Also tonight, Senate Minority Whip Richard Ross will appear on the second half of Fox 25's expanded 6 p.m. newscast to discuss parole reforms. Senator Ross is the ranking Senate Republican on the Joint Committee on the Judiciary, which is scheduled to hold a hearing on these bills on Wednesday at 1 p.m.

Tomorrow morning, Assistant Senate Minority Leader Robert Hedlund will be a guest on the Fox 25 Morning News, where he will discuss his re-filed "X" registrations bill, which seeks to crack down on illegal immigrants by requiring a valid drivers license to register a car in Massachusetts. The segment is scheduled to air live at approximately 7:45 a.m. Tuesday.

Also tomorrow, Senator Tarr will be calling in to the Jeff Katz Show, which airs weekday mornings on Rush Radio 1200 AM. The segment on parole reforms is scheduled to begin at approximately 8:15 a.m.

Investigating MBTA Commuter Rail Troubles

Yesterday the Massachusetts State Senate Republican Caucus formally requested public hearings by the Joint Committee on Transportation and the Senate Committee on Post Audit and Oversight be conducted to determine the causes of the many service disruptions in the MBTA Commuter Rail system that have occurred over the past several months.

The hearings that the caucus requested would provide an opportunity for the public, government officials, and transportation experts to identify the cause of the service disruptions and solutions to prevent them from happening in the future.

Senator Knapik Touts Restaurant Tax Holiday

Senator Michael R. Knapik (right) was featured prominently in a story on MassLive.com this morning touting the virtues of the Senate Republican Caucus' proposed restaurant meals tax holiday, which is supported by a number of Democrats. The Caucus is calling for a temporary week-long suspension of the sales tax on meals to provide tax relief to Massachusetts residents while generating additional revenues for restaurant owners who are struggling with the sluggish economy.

Senate Minority Leader Bruce Tarr was a guest on WRKO's "Tom and Todd Show" this morning. During the on-air interview, Senator Tarr was asked about Wisconsin Governor Scott Walker's recent crackdown on labor unions and whether similar legislation curbing union powers could pass in Massachusetts. Tarr also shared his thoughts on how the state can assist cities and towns with rising health care costs and discussed other GOP reform proposals to rein in government spending and reduce the state's structural budget deficit. Competing for Better Government

The Pioneer Institute is a Boston-based public policy research center that is celebrating its twentieth year of working to improve state government. Among the institute's more celebrated initiatives is its annual "Better Government Competition" which solicits, analyzes, and rewards ideas for making state government more efficient and effective.

Senate Minority Leader Bruce Tarr has been honored in the past to serve as a judge for this competition, and it often provides the substance of legislative reform.

Debate Over 'Hack Holidays' Heats Up Again

Last year, when Governor Patrick signed the Fiscal Year 2011 state budget, it included an outside section mandating that all government offices in Suffolk County be open on Evacuation Day (March 17) and Bunker Hill Day (June 17) to better serve the public. Now things seem to be heating up once again as individuals working in Suffolk County on those two days will now be paid holiday-pay due to union contracts. Senator Tarr Issues Statement on Unemployment Insurance Rate Freeze Vote

Senate Minority Leader Bruce Tarr has released the following statement regarding today’s Senate vote on Senate Bill No. 8, a proposal to freeze the unemployment insurance rate for Massachusetts’ employers:

“By taking action today and freezing the rate schedule, we are effectively reducing the average premium increase for employers from a devastating 40 percent to a more manageable 10 percent, while saving them an average of $193 per employee. The Senate’s decision to take up this matter now reflects the sense of urgency that we all feel in trying to provide immediate financial relief to the state’s small businesses. The money that will thus remain in the private sector will pay lasting dividends by spurring economic growth and recovery from the recession.

I want to be clear, however, that the Senate Republican Caucus’ support of this rate freeze is by no means an indication that we are satisfied with continuing with the status quo. On the contrary, we see today’s vote as nothing more than a stop-gap, band-aid approach to a much bigger problem that will require substantial reforms if we hope to achieve true and lasting long-term relief for the businesses we rely on to create jobs and drive the state’s economy. We look forward to a vigorous debate on these reform proposals as the new legislative session unfolds, and we will do everything in our power to ensure that this debate takes place as soon as possible.”



Senator Hedlund Discusses 'Melanie's Law' Reforms with Fox 25's Gene Lavanchy

Senate Assistant Minority Leader Robert Hedlund made an in-studio appearance on the Fox 25 Morning News on Tuesday to discuss the state's efforts to strengthen its drunk driving laws with co-host Gene Lavanchy. Senator Hedlund has re-filed legislation to close some of the loopholes in Melanie's Law, which was passed in 2005 and targets repeat offenders. Senator Tarr Announces 2011-2012 GOP Committee Assignments


Senate Minority Leader Bruce Tarr (R-Gloucester) has announced the following Republican committee assignments for the 2011-2012 legislative session:

Senate Assistant Minority Leader Robert L. Hedlund (R-Weymouth) has been named to the Senate Committee on Post Audit & Oversight and the Senate Committee on Global Warming & Climate Change. Hedlund will also serve as a member of the Joint Committees on Children, Families & Persons with Disabilities; Community Development & Small Business; Elder Affairs; Environment, Natural Resources & Agriculture; Housing; Labor & Workforce Development; Public Health; and Transportation.

Senator Michael R. Knapik (R-Westfield), the ranking Republican member of the Senate Ways & Means Committee, will retain that position and will also serve as a member of the Senate Committee on Ethics & Rules and the Senate Committee on Bonding, Capital Expenditures & State Assets. In addition, Knapik has been named as a member of the Joint Committees on Consumer Protection & Professional Licensure; Election Laws; Financial Services; Public Service; Revenue; Telecommunications, Utilities & Energy; and Veterans & Federal Affairs.

Senate Minority Whip Richard J. Ross (R-Wrentham) has been named to the Senate Committee on Ethics & Rules and the Senate Committee on Ways & Means. Ross will also serve as a member of the Joint Committees on Economic Development & Emerging Technology; Education; Higher Education; Judiciary; Mental Health & Substance Abuse; Municipalities & Regional Government; and Public Safety & Homeland Security.

Tarr, who is currently serving his first term as Minority Leader, will serve on the Senate Committee on Bills in Third Reading and the Senate Committee on Steering & Policy. His Joint Committee assignments include Health Care Financing; Redistricting; State Administration & Regulatory Oversight; and Tourism, Arts & Cultural Development.

More Work to be Done on Jobs Creation

The statewide unemployment rate in Massachusetts is holding steady at 8.2 percent, a promising sign after hitting 9.3 percent in December of 2009. But according to the State House News Service, not all areas of the state are sharing in this positive trend on the jobs front.

Citing local employment figures released today by the Executive Office of Labor and Workforce Development, the State House News Service is reporting that “unemployment rates in December rose in half of the state’s 22 labor market areas.” In some areas of the state, unemployment still remains in double-digits, including Fall River (13.8 percent), New Bedford (14 percent) and Athol (11.7 percent).

The latest unemployment figures serve as a stern reminder that the Commonwealth still has a long way to go before it can recover the thousands of jobs lost during the global recession and create a more business-friendly environment that will encourage companies to grow and expand here. The Senate Republican Caucus considers jobs creation a top priority, and will be offering a variety of legislative proposals to accomplish this goal during the 2011-2012 session.

The bi-partisan parole and sentencing reform bill unveiled at yesterday's State House press conference has been drawing considerable media attention.

Senate Minority Leader Bruce Tarr, the bill's lead sponsor, was a guest on Fox 25's 10 o'clock News Monday night and on the Fox 25 Morning News earlier today (see video clips below). Tarr was also interviewed by former Boston Phoenix reporter Adam Reilly for a pre-taped segment that ran on WGBH's Greater Boston last night (Senate Minority Whip Robert Hedlund was host Emily Rooney's in-studio guest, along with former Senator Warren Tolman). Senator Tarr Talks Parole Reform on Fox25

Senate Minority Leader Bruce E. Tarr will be an in-studio guest on tonight's Fox 25 News broadcast at 10:00 p.m. Tarr will be discussing legislation he has filed with many of his Senate colleagues -- Republicans and Democrats -- to reform the Massachusetts Parole Board and the criminal sentencing process.

Senators Unveil Parole Board Reforms

Senate Minority Leader Bruce E. Tarr (R-Gloucester) and Senate Ways and Means Vice Chairman Steven A. Baddour (D-Methuen) are leading a bipartisan coalition of Senators calling for a series of comprehensive reforms at the state's parole board, including stronger sentencing laws for repeat offenders. The coalition, which includes all four members of the Senate Republican Caucus, held a press conference at the State House this afternoon to unveil their proposal.

GOP Seeks Objectivity in Redistricting

The Senate Republican Caucus issued the following press release today regarding the need for an independent redistricting commission:

Seeking to infuse the redistricting process with objectivity and avoid the legal challenges that have tarnished the process in the past, the Senate Republican Caucus is calling for the establishment of an independent redistricting commission to assist lawmakers in the drawing of new legislative boundaries for members of Congress, the Legislature and the Governor’s Council.

Senate Republicans have filed language to create the new advisory commission, which will be charged with developing a redistricting plan that will be subject to legislative approval prior to its implementation. The Senate is scheduled to take up the proposal as part of its rules debate on Thursday, January 20, but the Caucus will also be filing it as a stand-alone bill for the 2011-2012 session.

“The voting rights of every citizen in the Commonwealth are affected by redistricting, and it requires our strongest efforts,” said Senate Minority Leader Bruce E. Tarr. “The commission we are proposing would infuse objectivity and expertise into a very complex process that would benefit from both. Our voters deserve the best we can give to redistricting, and the commission would provide guidance free from the traditional politics that have decided who we send to Beacon Hill and Capitol Hill.”

The League of Women Voters, Common Cause, former Governor Mitt Romney and Governor Deval Patrick have all endorsed the concept of an independent redistricting commission in the past. A MassINC poll released earlier this month shows that 62 percent of Massachusetts residents also favor using such a commission.

“Poll after poll has shown the public has grown tired of the traditional political games surrounding redistricting,” noted Senator Michael R. Knapik. “An independent commission would ensure that districts are apportioned appropriately in an impartial manner guided by principle and rooted in fairness. This legislature should move beyond power plays and parochialism and adopt districts that make historical, geographic, and economic sense.”

Senate Republicans have proposed creating a seven-member redistricting commission, which would be comprised entirely of non-elected individuals who would be selected based on their civic involvement and their knowledge of redistricting policy, civil rights, political science, voting rights and other areas of expertise. The proposal also requires that the members reflect, as much as possible, the geographic, racial, ethnic, gender and age diversity of the state’s population.

Under the proposal, the Governor would appoint a dean or professor of law, political science or government from a Massachusetts institution of higher learning, while the Attorney General would select a retired justice and the Secretary of State would name an expert in civil rights law. To ensure bipartisan balance on the commission, the four remaining members would be chosen from a list of nominees submitted by the House Speaker, House Minority Leader, Senate President and Senate Minority Leader.

“The concept of an independent commission clearly favored by Massachusetts residents, will take the politics out of the process and in so doing help to ensure fairness and integrity in our electoral process,” said Senate Minority Whip Robert L. Hedlund.

The Caucus proposal calls for the commission to hold public hearings across the state, and to release a preliminary redistricting plan for public comment no later than April 20, 2011. A final, revised plan would be submitted to the Legislature’s redistricting committee by July 29, 2011.

“It is imperative that the redistricting process not only be fair but free of political influence,” said Senator Richard J. Ross. “By establishing an independent redistricting commission, I believe we will be able to obtain the best legislative districts possible while making sure all constituents are well represented.”

Sen. Tarr's Statement on Parole Board Reforms

Senate Minority Leader Bruce E. Tarr released the following statement concerning Governor Patrick’s announcement today of his planned “action steps” to reform the state’s Parole Board:

“The Governor has taken important steps to arrest the threat to public safety presented by the current parole board and its methods of operation. Now the clock begins ticking on the process of implementing lasting and substantial reforms that will dismantle the processes that have so clearly failed us and to rebuild a parole and sentencing system where a life sentence means a life sentence and professionals in law enforcement have the necessary standing in parole decisions to keep us all safe.

We look forward to receiving and reviewing the report ordered by the Governor as soon as possible. Based on our review of the report, and in consultation with criminal justice professionals, we’ll be coming forward with a comprehensive series of legislative steps to promote fairness, predictability, truth in sentencing and public safety.”

Boston Globe: Time to Repeal Pacheco Law

Be sure to check out today’s Boston Globe editorial, which highlights something the Senate Republican Caucus has been saying for years now: the state’s Pacheco Law is depriving the Commonwealth of significant savings that could be achieved through privatization and outsourcing and should be repealed.

Although the Globe employs at least one outspoken critic of the 1993 law on its op-ed page (see our May 7, 2010 posting, “Boston Globe’s Scot Lehigh Backs Repeal of ‘Misguided’ Anti-Privatization Pacheco Law”), this is the first time the Globe has editorialized in support of repealing the law, which it describes as “an affront to common sense.”

“The so-called Pacheco Law doesn’t just keep government agencies from saving money by hiring outside contractors to perform certain services,” the Globe writes. “It also sends a broad message: In Massachusetts, the demands of special-interest groups – in this case, public-employee unions – can outweigh the obligation to run government efficiently.”

The repeal of the Pacheco Law is just one of many cost-saving government reforms on the Senate Republican Caucus’ legislative agenda for the 2011-2012 session.

Senate GOP Caucus Members Join in Bi-Partisan Call for Parole Board Reforms

Members of the Senate Republican Caucus joined with 16 of their Democratic colleagues yesterday to call on the state's Parole Board to temporarily suspend all parole hearings until an investigation is completed into the December 26th shooting death of Woburn police officer John Maguire by parolee Dominic Cinelli. Cinelli was paroled in 2009, despite being sentenced to three concurrent life terms stemming from a lengthy list of criminal offenses.

The bi-partisan coalition of senators submitted a letter to Parole Board Chairman Mark Conrad yesterday, requesting that he implement an "immediate moratorium" on parole hearings until the board completes its review.

"To allow the scheduled hearings to proceed as planned, without taking corrective measures to prevent another senseless tragedy, would be a slap in the face to those individuals and families who have been victimized by violent crimes," the senators wrote. "Protecting the safety of the residents of the Commonwealth is of the utmost importance, and we are prepared to work with you to implement the reforms needed to accomplish this goal."

Senator Knapik Named to Bi-Partisan Special Committee on Probation Department Reform

Senator Michael R. Knapik (right) has been appointed to the Special Committee on Probation Reform, which will be charged with providing recommendations to the Legislature for restructuring the embattled Massachusetts Department of Probation.

Joining Knapik on the committee are Senators Cynthia Stone Creem (D-Newton) and Brian A. Joyce (D-Milton), and Representatives Patricia Haddad (D-Somerset), Byron Rushing (D-Boston) and Jay Barrows (R-Mansfield). Also serving on the committee are three appointees of Governor Patrick, including Executive Office of Public Safety General Counsel Gregory Massing, Executive Office for Administration and Finance General Counsel David E. Sullivan, and First Assistant Deputy Legal Counsel to the Governor Abim Thomas.

"I am pleased the Senate President has asked me to serve on this committee," Knapik said. "It is imperative that we work to earn back the public's trust for this very important department."

Last month, the Supreme Judicial Court released the findings of a report that called into question the hiring practices of the Probation Department. The report, which recommended disciplinary action against department leadership, was commissioned in response to a Boston Globe "Spotlight Series" that exposed a culture of political patronage at the agency where individuals "sponsored" or connected to influential state leaders were often favored over more qualified applicants for positions in the department.

The Supreme Judicial Court has commissioned its own panel, to be led by former Massachusetts Attorney General Scott Harshbarger, to review hiring and promotion procedures throughout the entire judicial system. Harshbarger's team is expected to file a report on the Probation Department within 90 days and a report encompassing the rest of the Trial Court departments within six months.

"The citizens of Massachusetts deserve a Probation Department dedicated to the cause of public safety and ensuring that probationers are living up to the terms of their sentencing," Knapik said. "I am confident this committee will recommend reforms to the hiring process and department administrative functions with these goals in mind."

Knapik said his committee is expecting to file its report by the end of January.

Senator Tarr Holds Annual Toy Drive

Assistant Senate Minority Leader Bruce E. Tarr (left) and North Shore 104.9 FM will be hosting their 15th annual North Shore Holiday Toy Drive on Thursday, December 9.

The live broadcast runs from 6 a.m. to 6 p.m., with stops scheduled in Beverly, Lynn, Marblehead, Middleton, Ipswich, Essex, Manchester, Rockport and Gloucester. However, toy donations will be accepted at designated locations throughout the North Shore until Friday, December 17.

Remembering Pearl Harbor

Today marks the 69th anniversary of the Japanese attack on Pearl Harbor, an event that mobilized the entire nation and precipitated America's entry into World War II.

President Franklin D. Roosevelt declared December 7, 1941 "a date that will live in infamy." More than 2,345 U.S. military personnel were killed, and another 1,247 wounded, in the early morning surprise attack.

Today, Scaling The Hill remembers and pays tribute to the many men and women who served at Pearl Harbor, including those who made the ultimate sacrifice. We also salute those who are currently serving overseas to help keep America strong.

Senator Tisei Delivers His Farewell Speech

Senate Minority Leader Richard R. Tisei delivered his farewell address to his Senate colleagues yesterday afternoon, and the State House News Service's Mike Deehan was there to record it.

Twenty-six years ago, at the age of 22, Senator Tisei made his first successful run for elected office, winning an open seat in the House of Representatives to represent the residents of Lynnfield and Wakefield. After serving three terms in the House and 10 in the Senate, he still holds the distinction of being the youngest Republican ever to be elected to the MA House.

One Step Up, Two Steps Back

So much for progress on the jobs front.

Last month, Governor Patrick was trumpeting the news that Massachusetts employers had added 10,000 new jobs in October, following two straight months of job losses. But those short-term gains threaten to be swept away by a series of layoff announcements that have been making headlines since the November 2 election.

Today's announcement that State Street is eliminating 400 jobs follows reports of significant job losses at other big-name employers, including Genzyme, Biogen and Raytheon. General Electric, which has already laid off 600 workers this year, is threatening to cut even more jobs, but is asking the state for a $25 million tax credit to limit the number of new job cuts to 150.

Clearly the state's economy is not "on the mend and on the move," as Governor Patrick would like everyone to believe. Unless serious steps are taken to make Massachusetts more competitive, jobs will continue to disappear from our state at an alarming rate.

Senator Tarr Elected New Minority Leader

Assistant Senate Minority Leader Bruce E. Tarr (left) has been unanimously chosen by his colleagues to lead the Senate Republican Caucus during the upcoming 2011-2012 legislative session as the new Senate Minority Leader.

A member of the Massachusetts House of Representatives from 1991-1994, Tarr has served in the State Senate since 1995 and will formally assume the title of Minority Leader on January 5, 2011. Tarr succeeds Senator Richard R. Tisei, who has served in the Legislature since 1985 and as Senate Minority Leader since 2007.

ON THE AIR: Senator Tarr Offers His Suggestions on Ways to Improve Melanie's Law

Assistant Senate Minority Leader Bruce E. Tarr joined Fox 25 Morning News co-anchor Gene Lavanchy on Wednesday morning to discuss a new report by the National Transportation Safety Board that suggests Massachusetts is not doing enough to crack down on repeat drunk drivers. Senator Tarr agreed that the state's newest anti-drunk driving law -- known as Melanie's Law -- can be improved to make our roads safer.

One idea backed by Senator Tarr is a proposal to prevent repeat offenders from being able to "bundle" multiple charges to avoid harsher punishment. Senate Minority Whip Robert Hedlund will be filing a bill to this effect when the new legislative session convenes in January.

Senate GOP Caucus Responds to Governor's Statement on Supplemental Budget

Senate Minority Leader Richard R. Tisei issued the following statement today on behalf of the Senate Republican Caucus in response to Governor Patrick’s statement regarding the supplemental budget currently pending before the Senate:

“Today, prior to the Senate’s consideration of a $420 million supplemental spending bill, the members of the Republican Caucus of the State Senate asked the Governor three straightforward questions regarding the fiscal viability of the Commonwealth and the long-term plan for Fiscal Year 2011. The Governor’s refusal to answer these questions is indicative of his lack of leadership and his lack of stewardship over the state budget the past four years.

Again, we call on the Governor to publically provide details of the fiscal status of the programs that are in deficiency a mere three months into the state’s fiscal year. The Governor needs to open up the state’s books so that we can make an informed decision as we consider the supplemental budget before the Senate.”
